Assessment Inventory Data Not Available under FOIL
A petitioner has no right to obtain a copy of real estate assessment inventory data for personal or business purposes, according to the decision of the Appellate division, Second Department on October 17, 2006. In the matter of Comps, Inc. v. Town of Islip the court held that the tax assessment rolls are available, but not the inventory data, which are exempt from the New York State Freedom of Information Law because the release of that data would constitute an unwarranted invasion of personal privacy. The inventory data are available expressly for the purpose of allowing taxpayers to inspect the records during the specified time before completion of the assessment roll for the purpose of correction of potential errors.
