The Warrensburg Town Board tried to slip through a severe
sign ordinance at the end of the year that would have prohibited
the big sign with the symbol “NO APA”
and the PRFA web site URL on Ted Galusha’s house
on Route 9. The townspeople got angry.

A sign law proposed by the Warrensburg Town Board was apparently
targeted at two private homes where political statements were
displayed. One target was Ted Galusha’s house on
New York State Route 9, where the wall facing southbound traffic
is almost covered by a large display against the Adirondack Park
Agency: a NO APA symbol above the URL of the Property Rights
Foundation of America, www.prfamerica.org. If enforced, the proposed
law would have been an unconstitutional infringement of speech.

The First Amendment provides, “Congress shall
make no law…abridging the freedom of speech, or of
the press.” In 1994, the U.S. Supreme Court struck
down a Missouri city law prohibiting signs at private residences.
The unanimous decision rejected the ordinance in City of Ladue
v. Gilleo, writing that residential yard signs were “a
venerable means of communication that is both unique and important.”
