Dear Ms. LaGrasse: Pursuant to your Freedom of Information Law (FOIL) request dated October 21,2002 and received in this Office on October 28, 2002, please be informed that this Office has conducted research regarding your request. Referring to your request labeled No. 1 in the first half of your letter, please be informed that 52 permits were issued by DEP since January 1, 1997 across its lands to properties that are privately owned. In reference to all your other requests, we are hereby denying access to the records based on Section 87.2.(f) of the FOIL which states (each agency shall...make available for public inspection and copying all records, except that such agency may deny access to records or portions thereof that:...if disclosed would endanger the life or safety of any person;...). We are invoking this exemption in the after-math of the events of September 11, 2001.
