REQUESTING NEW YORK STATE TO
ABIDE BY ITS LAWS FOR ROADS IN THE FOREST PRESERVE
WHEREAS, the State Land Master Plan calls for Unit Management Plans throughout the Adirondack Forest Preserve lands; and
WHEREAS, the law establishing the Forest Preserve prohibits any rules or regulations that interfere with the free use of any road, stream or water body; and
WHEREAS, Section 205-b of the highway law states that all roads and public right-of-ways in the forest preserve shall remain open in perpetuity with the Town in which they are located; and
WHEREAS, the closing of any local road in the Forest Preserve under the guise of unit management planning is in direct violation of State laws; and
WHEREAS, the closing of these local roads results in the vast majority of the public being denied access to the use of these lands; and
WHEREAS, only a small group of hikers are allowed access and use of these lands if they are unlawfully closed by the State; and
WHEREAS, hikers pay no use fees, but utilize taxpayer funds to support their trails.
NOW, THEREFORE BE IT RESOLVED, that all local Town roads remain open to all the taxpayers of the State; and be it further
RESOLVED, that all Town roads that have been closed illegally since the enactment of the laws establishing the Forest Preserve be reopened according to the law; and be it further
RESOLVED, that no State funds shall be spent on any trail or road unless it benefits the entire public sector; and be it finally
RESOLVED, that the Town Board of the Town of Schroon directs that a copy of this Resolution shall be forwarded to all organizations, agencies, and legislators who share or need to be made aware of the concerns of the people of New York.
